The president's own party wrote a bill that reins in the president. That's either a genuine ethics win or a poison pill designed to kill the whole thing. The revised CLARITY Act language started circulating Wednesday and it's the most consequential version we've seen, and finally has concrete text. The revised bill, negotiated with the White House, bars the president, vice president, members of Congress, federal judges, and covered officials, along with their spouses, from issuing or sponsoring digital assets for compensation while in office, running through January 20, 2029. Covered officials would have to divest crypto holdings or move them into a blind trust. And it grants the DOJ civil enforcement power to sue exchanges that list prohibited tokens. The provision sunsets in 2029 and regulators have a year to implement it. Senate Republicans, working with the Trump White House, wrote language that directly restricts Trump's own sprawling crypto empire, the meme coin, World Liberty Financial, the mining ventures, all of it. The president's party produced a bill that constrains the president. I suppose it's still only a year or two too late, but good to know someone's keeping tabs! This is the single biggest sign yet that the bill's backers are serious about passing it in 2026 rather than just posturing. The ethics provision was the one thing Democrats said they'd die on, and it's the one thing that could deliver the seven Democratic crossover votes needed to clear the 60-vote threshold. Putting genuine, Trump-constraining language in the text, even with a 2029 sunset, is how you actually get this thing to the floor. You don't hand your own president a leash unless you've decided passage matters more than the fight. The fact that the language exists at all, and that the White House signed off on constraining Trump specifically, tells me the political will to pass this before the August 7 recess is real in a way it wasn't a month ago. The sunset and the soft implementation timeline are compromises, but compromises are how bills become law. If this were a poison pill meant to kill the effort, they'd have made the ethics rules permanent and watched Republicans walk. They didn't. They made them temporary and survivable, which is exactly what you do when you actually want the thing to pass. Fifteen days left before recess. This is the closest crypto has ever come to a real US framework, and the mechanism that gets it there is a bill that puts a leash on the guy who campaigned as the crypto president. |
