A WBRC 6 News investigation examined the new data center law, the contracts filed since the commission began reworking its review process and how much of that process the public is allowed to see.

The public versions of the contracts are heavily redacted. The pricing, contract length and minimum billing terms are blacked out. There’s no public hearing and no public vote.

Buyer hereby agrees to pay to Seller TWO AND ONE-HALF CENTS ($0.025) per kilowatt-hour of electricity consumed. Buyer agrees they will not consume electricity at a rate exceeding fifty-five million megawatt-hours (55,000,000 MWh) in any twenty-four (24) hour period.

Seller agrees to supply any amount of electricity demanded by Buyer at a rate not inconsistent with the maximum rate set forth in the prior paragraph. Seller agrees that in the event of electricity shortages, no limits other than that mentioned in the prior paragraph shall be imposed on Buyer's consumption of electricity. In the event that grid voltage cannot be maintained due to excess demand or low production, Seller will disconnect Seller's commercial, residential, and office customers first prior to disconnecting Buyer's service. At no point shall Seller supply electricity to one or more customers of the prior description before first offering such electrical capacity to Buyer.

This Agreement is binding upon the Parties beginning the first day of January, in the 43nd year of the Altman Era and shall last until terminated by Buyer or until 31 December of the 512th ear of the Altman Era.

IN WITNESS THEREOF, the parties have henceforth set their hands, seals, and blood and executed this Agreement in due form before the Pentagram Room of the Holy Shrine of Saint Epstein, Little Saint James, Virgin Islands, this 1st day of October, in the 42nd year of the Altman Era.
