Hopefully this helps. But there is a LONG history of progressive legislature to minimize harm that cops just actively refuse to enforce. And considering this would require them to stand up to people in tacticool gear with a track record of murder... |

I love this. But isn't the second part basically like creating a law saying murder is now illegal? The illegal search and seizures were always illegal without a warrant. |

State vs federal. Traditionally, state legislatures didn't make such laws or rules because the constitution outlawed it. There was no need. But Republicans use the Constitution as toilet paper. So it's fallen to functioning states and municipalities to try to do anything about it. |

We really need to move to the point where if cops can't do whqt the city government tells them then they're fired or not being paid. If I knew I could just ignore whatever my boss tells me, never get fired or even seriously disciplined, and demand a raise every year, you bet your ass I'd be doing things however I want. |

Cop staffing is already below minimum levels. No one wants the (very real) PTSD that any emergency worker gets, for that kinda cash. I'd suggest we rehab them into proper cops but this is Lemmy. |

In a world where a literal police strike led to a lower rate of violent crime, this is not a claim that should be accepted without extraordinary evidence. At the very least, a city whose "cop staffing" is below their minimum should have an obvious increase in crime relative to comparable jurisdictions. |

It's a law saying these agencies need to audit their internal operations and document any murders they may have forgotten to report.
Because of the slapdash way these agencies often function, they'll do the crime first and then build the justification after the fact. Raising bureaucratic hurdles for police operations means increasing the risk that their bullshit won't fly. |

Im with you but
Is a wild claim to make without any evidence. EDIT: Found some evidence. https://www.nature.com/articles/s41562-017-0211-5 |

Hey when Mamdani's done fixing NYC, think he'll have some time to come visit some other places? I'd love to see his solutions in Las Vegas. Asking for friends who live there. I'm sure there's a lot of municipalities in dire need of a Mamdani or two. 👉👈 |

Yeah good luck with that. Federal Supremacy is still a thing, just like it was when the Obama Administration was fighting Arizona's state level immigration enforcement. It's well established that Federal Law Enforcement can enter nearly any space or building that is open to the public. They can potentially be barred from entering private spaces, such as offices, inside a building unless they have a judicial warrant but that's about it. Basically if you or I can walk in there then Federal LE can too and no Executive Order is going to change that. |

Sorry no, only one socialist office-holder in the country is allowed at any one time. I mean, a bunch of people on here would do it, but they don’t want to. |

The Confederacy was never for states rights. They made it illegal for their fellow traitor states to outlaw slavery, and before they rebelled were pushing for the northern states to abide by their state laws over the norths' own. |

Only because we have cops doing things cops shouldn't be doing, and aren't trained to do. We're sending in hammers to handle delicate situations and shocked when they try to bash their way through them. |

It's also federal law that requires they have warrants, so there's no conflict that would involve the supremacy clause. You or I can't just walk into a school or hospital whenever we want without valid reason. |

But are ICE agents likely to understand even well established legal precedent? This is at the point of being guerrilla legality, it's about using confusion to create delays for them wherever possible. |

To enter public property? Nope, you're wrong.
Since when? I can stroll into the lobby of a Hospital any time during business hours and so can Federal LE. Same with a school assuming the doors aren't locked. |

Why do you think this would confuse them? Their boss will spend about 30 seconds covering this one morning "I know that NYC did an Executive Order to keep us out of public spaces (room chuckles) but that doesn't carry any legal authority. Ignore it." I mean they seemingly ignore most other laws so even if this Executive Orders was enforceable, and it's not, what makes you think they wouldn't ignore this as well? |

ICE isn't just stopping in the lobby. The lobby is the place where you price you have a legitimate reason to enter the actual hospital. And it seems you have not been to a school in a couple of decades. That shit has been locked down since the early 00s. If you f don't have a kid in there, or were invited for some reason, they're not letting you in. |

But now there's an official directive clarifying the policy, and there's also going to be a designated person for each agency tasked with oversight/compliance. In addition to auditing their policies and making changes public, this is huge. It's more tangible action than any other local official has done so far. |

The part about adding a compliance officer to each agency should help with that, as long as it's implemented intelligently which I believe Mamdani is capable of |

You can add as many compliance officers as you want to. Hell, you can grab ALL the cops who hang out at high schools and sexually harass/assault kids and make this their job. It won't matter if they actively choose not to resist. Which is what almost always happens with stuff like this. I like Mamdani's messaging a lot. Stuff like this... reminds me about how worried I am about his ability to act on that messaging. But, "fortunately", the christofacists are more focused on attacking Minnesota and Illinois than New York so this might not have to meaningfully be tested. |

That's why I said if it's implemented well. Good implementation implies selecting the right people for the job. A compliance officer doesn't have to be a cop, he could hire someone from the public defender's office or even a civil sector human rights org |

Yeah, I thought of that, but it would be just as easy for someone at the building to be like "I know your boss probably said you can just bust in here, but that's not how the law works. You still need a warrant." |

Maybe MAGA will ignore it, but at least you are forcing them to break an actual law, which you can now hold against them. Up until now, we've been expecting them to behave better because it the right thing to do, and they don't care about that, of course. Now we can expect them to behave better because it's an actual law that we can punish them with. Mamdani has issued the Executive Order, I assume he is willing to enforce it. Just because Dems in the past have done nothing to stop MAGA, doesn't mean the future Democrats are going to be just as cowardly. The new Dems coming into office are angry, determined, and motivated. They are NOT going to behave the same as the cowardly weaklings from the past. Once we get past the Midterms, Dems should eliminate the MAGA comedy act of Schmuck & Jeffries, and elect Congressional leaders who WANT to fight for America and it's citizens. |

They're already breaking actual law and What Mamdani has done is just an Executive Order. His EOs are no more "law" than fucking Trump, Obama, or Bush Jr's were. |
