The executive order redefines “subject to the jurisdiction” as applying only to lawful permanent residents or citizens. What makes such a description so fraught is precisely the fact that the criteria for permanent residency discriminate sharply based on national origin, with many languishing for years or decades on nominally temporary status if not in the legal limbo of formally illegal, but unofficially tolerated undocumented immigration. This is very transparently an attempt at shaping the electorate in a demographic direction that more readily swallows up white idpol, while creating a second class of residents with no suffrage in the only country they have ever known, directly contravening the purpose of the 14th Amendment. My suspicion is that the Supreme Court tortures the meaning of the text to open some holes in the amendment (they are, after all, in favor of the Christofascist agenda), but requires that any changes to nationality law go through Congress, raising the stakes of 2026 even higher.
